The Cass County Planning Commission will conduct a regular meeting Monday April 9, 2018 in the meeting room of the Cass County Land Department located at 218 Washburn Ave, Backus MN.

    

The field inspection will be conducted Monday, April 2, 2018.  A schedule is included in this notice with an estimated time of arrival at the application locations.    

9:30 AM – Call to Order.  Review agenda.  Approve minutes.   

Variance

9:40 AM – Grimler, Connie & Tom, Shingobee Township on property described as Part of NW NE, Section 30-141-31, PID #38-030-1201 located at 5496 Howard Lake Road NW.  An application submitted to excavate 55 to 75 cubic yards of material within the bluff located on the property.  The applicable portions of the Land Use Ordinance include Section 800, which establishes the variance criteria and Section 1106.3 A. prohibits excavation within a bluff impact zone.  The property contains 1.4 acres non-riparian within the shoreland zone (.25 mile) of Howard Lake (RD).  The field inspection for this application will be conducted 04/02/18 at 9:30 AM.

10:00 AM – Perlenfein, Thomas, Shingobee Township on property described as Lot 10, “Shady Lane”, Section 30-141-31, PID #38-446-0100 located at 5471 Howard Lake Road NW.  An application submitted to construct 24 feet x 40 feet residential structure to be located 45 feet from the lake and 16 feet from the right-of-way of Howard Lake Road.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria and Section 1126.1 A. & B. which requires structures to be located 100 feet from a lake classified Recreational Development (RD) and 20 feet from the right-of-way of a public or platted roadway.  The property contains .14 acre riparian to Howard Lake (RD).  The field inspection for this application will be conducted 04/02/18 at 9:15 AM.

10:15 AM – Peters, Steve, Kego Township on property described as Lot 19, “Blair’s Pine Gables”, Section 33-141-28, PID #19-477-0190 located at 4858 Barclay Drive NE.  An application submitted to expand a non-conforming residence with an 11 feet x 14 feet addition to be located 77 feet from the lake.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria and Section 1115.3 C. which requires the expansion of non-conforming structure at less than a required setback to obtain a variance.  The property contains .71 acre riparian to Girl Lake (RD).  The field inspection for this application will be conducted 04/02/18 at 1:00 PM.

10:30 AM – Raisch, Shauna, Pine Lake Township on property described as Lot 6, Block 2 & 1/9 Interest in Outlot C, “Whipholt Lakeshore Village”, Section 8-141-29, PID #30-379-0230 located at 1652 Whipholt Beach Road.  An application submitted to construct a full basement under a residence which is non-conforming because it is located at less than 75 feet from the lake.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria and Section 1115.3 C. which requires the expansion of non-conforming structure at less than a required setback to obtain a variance.  The property contains .04 acre riparian to Leech Lake (GD).  The field inspection for this application will be conducted 04/02/18 at 10:15 AM.

Conditional Use Permit

10:45 AM – Central States Tower III, LLC, Boy Lake Township on property owned by Vicki Peterson Revocable Living Trust described as SE SW, Section 33-142-28, PID #07-033-3400 located at 966 72nd Street NE.  An application submitted to construct a 290 feet communication tower.  The applicable portions of the Land Use Ordinance include Section 705, which establishes the conditional use permit (CUP) criteria and Section 1127 which establishes the communication tower criteria.  The property contains 41.5 acres riparian to Haugen Lake (NE).  The field inspection for this application will be conducted 04/02/18 at 11:00 AM.

Variance/Reclassification/Conditional use Permit

11:15 AM – Loren Propereties LLC, Wabedo Township on property described as Part of Govt Lot 5, Section 23-140-28, PID #46-023-3405 located at 1650 Wabedo Frontage Road NE.  An application for a variance to the minimum lot width requirement of 300 feet at the OHWL, to reclassify the property from the current Shoreland Residential (SR) to Water Oriented Commercial (WOC) and for a Conditional Use Permit (CUP) to establish and operate the existing structure configuration as a resort.  The applicable portions of the Land Use Ordinance include Section 705 which establishes the conditional use permit criteria, Section 706 which establishes reclassification criteria, Section 800 which establishes the variance criteria, Section 903 which establishes land use district descriptions, Section 1113 which requires that WOC lot be at least 300 feet wide at the OHWL, and Section 1001 that a resort use be located in an area classified and that a CUP is required to operate a resort.  The property contain 4.3 acres with 200 feet at the OHWL riparian to Lake Wabedo (RD) and is classified Shoreland Residential (SR).  The field inspection for this application will be conducted 04/02/18 at 1:30 PM.
