The Cass County Planning Commission will conduct a regular meeting Monday March 12, 2018 in the meeting room of the Cass County Land Department located at 218 Washburn Ave, Backus MN.

    

The field inspection will be conducted Monday, March 5, 2018.  A schedule is included in this notice with an estimated time of arrival at the application locations.    

9:30 AM – Call to Order.  Review agenda.  Approve minutes.   

Conditional Use Permit

9:40 AM - Beach Club LLC/Quarterdeck Resort, Fairview Township on property described as RLS #25, Tract A, Section 6-134-29, PID #14-006-4102, Lot 1, Block 2, “Quarterdeck Resort”, Section 5-134-29, PID #14-362-0202, RLS #29, Tract D, Section 5-134-29, PID #14-005-3207, RLS #29, Tract E, Section 5-134-29, PID #14-005-3208 & RLS #29, Tract F, Section 5-134-20, PID #14-005-3209 located at 9820 Birch Bay Drive.  An application submitted to develop the area recently reclassified Water Oriented Commercial (WOC) with resort guest accommodations structures, staff accommodations structure and a facilities structure to house various resort maintenance services and related vehicles.  The applicable portions of the Land Use Ordinance include Section 705 which establishes the conditional use permit (CUP) criteria and Section 1104.9 resort development and expansion criteria.  The resort contains 31.9 acres with the area included in the CUP application of 11.05 acres non-riparian within the Shoreland Area (¼ mile) of Gull Lake (GD) classified Water Oriented Commercial (WOC).  Consideration of this application is continued from the February 12, 2018 meeting.    

10:00 AM – Bell, Susan, Ponto Lake Township on property described as Lot 5, Block 1, “Idle-A-While”, Section 4-139-29, PID #32-352-0140 located at 2263 East Long Lake Drive NW.  An application submitted to establish a Family Campground consisting of one existing residence and four RVs all to be utilized for family purposes and not available to the public.  A Family Campground is defined as, “Two or more residential structures and associated accessory structures on the same lot used and managed jointly by members of a family”.  The applicable portions of the Land Use Ordinance include Section 705 which establishes the CUP criteria and Section 1121 which establishes Family/Private Campground criteria.  The property contains 2.88 acres riparian to Long Lake (RD).  Consideration of the application is continued from the February 12, 2018 meeting.

10:30 AM – Central States Tower, LLC, Woodrow Township on property owned by Lee, Candace & Motzko, Daniel described as E 308 Feet of Govt Lot 8, Section 9 140-29, PID #51-009-4101.  An application submitted to construct a 190 feet communication tower to be located at the junction of Buxton Road NW and Gerner Road NW.  The applicable portions of the Land Use Ordinance include Section 705, which establishes the conditional use permit (CUP) criteria and Section 1127 which establishes the communication tower criteria.  The parcel contains 10.2 acres riparian to Child Lake (RD).  Consideration of this application is continued from the February 12, 2018 meeting.   

Variance

11:30 AM – Johnson, James, Woodrow Township on property described as Lots 37 Thru 41, “Interlachen Lodge”, Section 8-140-29, PID #51-378-0370 located at 4212 Interlachen Drive NW.  An application submitted “after the fact” to be allowed to retain the living area on the upper level of an accessory structure that was specifically prohibited by Condition #3 of the approval of VP13-140-29-7.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria and Section 1.8 of the Environmental Definitions Ordinance, Accessory Structure: “A structure which is subordinate to and serving the principal structure, does not include living quarters and customarily incidental to the land use district in which it is located.  The property contains 1.35 acres riparian to Baby Lake (RD).  As requested by the Planning Commission during their 01/08/18 meeting, the applicant has submitted a plan for consideration to reconfigure the structure to comply with current guest quarters standards.  The field inspection for this application will be conducted 03/05/18 at 10:45 AM.

1:00 PM – Storby, Curtis & Robyn, Birch Lake Township on property described as Lot 1, “Longbow on Poquet Lake” & Part of Gov Lot 2, Section 29-140-30, PID #05-439-0010 located at 3913 Poquet Drive NW.  An application submitted to construct a 32 feet x 36 feet, including deck, residence to be located 50 feet from the lake.  An existing residence located 20 feet from the lake will be removed.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria and Section 1126.1 which requires structures to be located 150 feet from a lake classified Natural Environment (NE).  The property contains 3.05 acres riparian to Poquet Lake (NE).  The field inspection for this application will be conducted 03/05/18 at 10:00AM.

Conditional Use Permit/Variance

1:15 PM – Goehring, Jason, Shingobee Township on property described as Lots 1 & 2, Block 1, “Plat of Shingobee Island” & Easterly ½ of Adjacent Portion of Vacated Old Hwy 34, Section 2-141-31, PID #38-347-0110 located at 7184 Dewdrop Trail NW.  A variance application submitted “after the fact” to be allowed to retain two existing access areas on the property and a conditional use permit application to establish a Family Campground consisting of two RVs to be utilized for family purposes and not available to the public.  A Family Campground is defined as, “Two or more residential structures and associated accessory structures on the same lot used and managed jointly by members of a family”.  The applicable portions of the Land Use Ordinance include Section 705 which establishes the CUP criteria, Section 800 which establishes the variance criteria, Section 1106.4 C.1. allows for one access per lot and Section 1121 which establishes the Family/Private Campground criteria.  The property contains .8 acre riparian to Leech Lake (GD).  The field inspection for this application will be conducted 03/05/18 at 9:15 AM.

Conditional Use Permit

1:45 PM – McCormick, Susan, Trust, Fairview Township on property described as Lot 25, “Birch Forest”, Section 24-134-30, PID #14-437-0240  located along Birch Forest Road SW.  An application submitted to place and grade 900 cubic yards of earthen material in order to provide driveway access to an undeveloped lot intended for the construction of a residence and a detached accessary structure/garage.  The applicable portions of the Land Use Ordinance include Section 705 which establishes conditional use permit process and criteria standards and Section 1106.2 which establishes the earthen material standards for the shoreland (.25 mile) area.  The property contains .8 acre riparian to Gull Lake (GD).  The field inspection for this application will be conducted 03/05/18 at 1:00 PM.

Reclassification

2:00 PM – Hanson, Dale & Debra, Moose Lake Township on property described as Gov Lot 1 Less N 468 Feet of W 373 Feet, Section 30-136-31, PID #27-030-2101 located at 6703 64th Street SW.  An application to reclassify an 846 feet x 420 feet portion of the of the property from Agriculture/Forestry (AF) to Rural Residential (RR-5) to allow from the new lot which will contain 8.15 acres.  The applicable portions of the Land Use Ordinance include Section 706, which establishes reclassification criteria and Section 903 which establishes land use district descriptions and includes a minimum lot size of 40 acres in the areas designated (AF) and 5 acres in the areas designated (RR-5).  The parcel currently contains 35.69 acres (AF).
