The Cass County Planning Commission will conduct a regular meeting Monday, July 9, 2018 at 9:30 AM in the meeting room of the Cass County Land Department located at 218 Washburn Avenue East, Backus MN.

The field inspections will be conducted Monday, July 2, 2018 and Tuesday, July 3, 2018. A schedule is included in this notice with an estimated time of arrival at the application locations.

9:40AM - - Askegaard, Erik, Fairview Township on property described as Lot 1, Block 1 Tamarak, Section 36 134 30, PID #14-455-0110 located at 11926 Gregory Dr SW. An application submitted to construct a 30’ x 50’ garage approximately 55’-60’ from the OHWL. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 75 feet from a lake classified General Development (GD). The property contains 14.4 acres riparian to Sylvan Lake (GD). The field inspection for this application will be conducted 07/03/18 at 2:00 PM.

10:00AM - - Cullen, Robert and Jane, Shingobee Township on property described as Part of Govt Lot 4, Section 25 141 31, PID #38-025-3418 located at 5305 County 50 NW. An application submitted to construct a 240 square foot deck 34’ from the lake and 7’ from the eastern property line. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. & B. which requires structures to be located 75 feet from a lake classified General Development (GD) and 10 feet from the property line. The property contains 0.45 acre riparian to Ten Mile Lake (GD). The field inspection for this application will be conducted 07/03/18 at 9:20 AM.

10:15AM - - Hendrixson, John and Karrie, Otter Tail Peninsula Township on property described as Hedon Harbor on Leech Lake Lot 1, Section 6 144 40, PID #28-550-0010 located at 2479 Harbor Drive NW. An application submitted to add onto an existing non- conforming residence/attached garage not to increase the setback from the lake. The planned addition is a 900 square foot second story to an existing garage. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 75’ from the OHWL of a GD lake. The property contains approximately 0.44 acre riparian to Leech Lake (GD). The field inspection for this application will be conducted 07/02/18 at 10:30 AM.

10:30AM - - LeMay, Steven, Sylvan Township on property owned by the Minnesota Power & Light Co. described as Part of the SW NW, MP&L Lease Lot 2, Section 19 133 29, PID #41-819-1302 located at 1821 W Gull River Road SW. An application submitted to construct a new 32’ x 50’ home approximately 61’ from the OHWL and move the existing structure north of the power lines. The owner/lease holder also proposes the removal of an outhouse. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 100 feet from a river classified as Urban and Tributary. The property contains 0.90 acre riparian to Gull River. The field inspection for this application will be conducted 07/03/18 at 1:30PM.

An application submitted to construct a new 28’ x 32’ cabin 70’ and install a SSTS 60’ from the OHWL. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. & B. which requires structures to be located 100’ and SSTS to be located 75’ from a lake classified Recreational Development (RD) respectively.  The property contains 1.90 acres riparian to Webb Lake (RD).  The field inspection for this application will be conducted 07/03/18 at 10:15 AM.

11:05AM - - Mercer, Dan and Pam, Ponto Lake Township on described as Part of Govt Lot 3, Section 15 139 29, PID #32-015-2213 located at 1583 State Hwy 84. An application submitted to construct a 12’ x 16’ shed to be located 80’ from the lake and 5’ from the eastern property line. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 100’ from a lake classified Residential Development (RD) and 1126.1 B. which requires structures to be located 10’ from the property line. The property contains 0.61 acre riparian to Ponto Lake (RD).  The field inspection for this application will be conducted 07/02/18 at 2:55PM.

11:20AM - - Moeckly, Aaron, Wabedo Township on property described as Part of Govt Lot 2, Section 21 140 28, PID #46-021-1301 located off of South Hunter Road NE. An application submitted to construct a new 28’ x 40’ cabin with attached enclosed porches (276 sf) 80 feet from the OHWL. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 100 feet from a lake classified Recreational Development (RD). The property contains 0.75 acre riparian to Hunter Lake (RD). The field inspection for this application will be conducted 07/02/18 at 1:45PM.

11:35AM - - Moraczewski, Matt, Slater Township on property described as Part of Govt Lots 4 & 5, Section 14 142 26, PID #39-014-4001 located at 8558 County 52 NE. An application submitted to reconstruct an existing non-conforming home on the current footprint and decrease the size of the deck to 204 square feet but moving it 2’ closer to the lake . The residence is non-conforming because it is located from 125’ feet from the lake. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1115.3 which establishes the criteria for non- conforming structure expansion and Section 1126.1 A. which requires structures to be located 150 feet from a lake classified Natural Environment (NE). The property contains 5.09 acres riparian to Knight Lake (NE). The field inspection for this application will be conducted 07/02/18 at 11:30AM.

1:00PM - - Stormo, Gerald, Pike Bay Township on property described as Lots 11 thru 14 of Little Wolf Look-Out, Section 07 145 31, PID #29-355-0110 located at 16104 73rd Ave NW. An application submitted to construct a 9’ X 16’ addition (north), a 6’ x 19’ addition (west) and a 13.5’ X 12.8’ deck (north) to an existing non-conforming residence. The residence is non-conforming because it is located 42’ feet from the lake and the additions/deck will not further encroach on the lake. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1115.3 which establishes the criteria for non-conforming structure expansion and Section 1126.1 A. which requires structures to be located 100 feet from a lake classified Residential Development (RD). The property contains 7.32 acre riparian to Little Wolf Lake (RD). The field inspection for this application will be conducted 07/02/18 at 9:40AM.

1:15PM - - Williams, David and Sharron, Birch Lake Township on property described as Part of Govt Lot 4 (Sw ¼ of the SW ¼), Section 07 140 30, PID #05-007-3301 located at 4775 Birch Lake LN NW. An application submitted to split a 19.44 acre parcel into 2 lots with 75’ of shoreline and >1.5 acres each. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1113.1 which requires minimum lot width to be 100’ in GD – Residential. The property contains 19.44 acres riparian to Birch Lake (GD). The field inspection for this application will be conducted 07/03/18 at 9:45AM.

1:30PM - - Zollars, Matt, Woodrow Township on property described as Lot 3 and Part of Lot A of Birch Park 1st Addition, Section 33 140 29, PID #51-520-0031 located at 2395 Birch Park Trail NW. An application submitted to construct a 40’ x 30’ pole barn less than 20 feet from the right-of-way of Birch Park Trail NW. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 B. which requires structures to be located 20 feet from the right-of way of a Township Road. The property contains 0.60 acre riparian to Long Lake #2 (RD). The field inspection for this application will be conducted 07/02/18 at 2:20PM.

Conditional Use Permit

1:45PM - - Woodrow Township, Bob Hankey, Woodrow Township on property described as Part of the NW SW, Section 15 140 29, PID #51-015-3204 located at 1103 County 5 NW. An application submitted to establish an extractive use consisting of gravel mining, crushing and storage on a portion of this parcel to be subdivided and purchased from Arvig. Such land use requires a conditional use permit (CUP). The applicable sections of the Land Use Ordinance include Section 705 which establishes CUP standards and Section 1107 which establishes the extractive use criteria and requirements. The property contains 14.6 acres (AF). The field inspection for this application will be conducted 07/02/18 at 3:30PM.

Other Business

2:00PM - - Elenkiwich, Dave & Sue, Woodrow Township on property described as Lots 45 Thru 49, Block 1, “Glens Point”, Section 9-140-29, PID #51-389-0170 located at 4294 Birchwood Drive NW. A Variance (VP17-140-29-1) was granted to replace the existing residence with a new 40’ x 60’ residence to be located from 53’ to 74’ from the lake. The Elenkiwichs are requesting a two-year extension of their approved 2017 variance with no requested changes to findings and conditions. The applicable portions of the Land Use Ordinance include Section 800 which establishes variance criteria, Section 1115.3 which establishes the non-conforming structure expansion and replacement criteria and Section 1126.1 A. which requires structures to be setback 100 feet from the OHWL of a lake classified Recreational Development (RD). The property contains 0.84-acre riparian to Baby Lake (RD).

2:15 PM - - Heinzen, Brandon and Sue, Woodrow Township on described as Lot 9 Block 1, “Minne-Teepe Portage”, Section 22 140 29, PID #51-452-0140 located at 827 County 11 NW. An application submitted to construct a 10’ x 12’ shed to be located 120 feet from the lake. The variance was granted on 6/11/2018 with the condition that a site inspection by ESD was necessary to verify the shed location. ESD inspected the project location following staking and determined the shed was planned to be placed at 110’ setback from the lake. Request to modify the variance (VP18-140-29-4) to indicate a 110’ setback for the shed.

2:30PM - - Kostial, Kenneth and Barbara, Woodrow Township. Section 24 140 29; PID# 51-024-3216. A request to modify variance permit V04-140-29-6 to remove condition 1 “The structure shall not be used as living quarters.” and to be able to use the addition to the garage as a living quarters. A request to extend VP14-140-29-1 which was extended in 2016 previously. This variance was granted for an addition to the existing non-conforming residence.
