The Cass County Planning Commission will conduct a regular meeting Monday August 13, 2018 and Tuesday, August 14, 2018 at 9:30AM in the meeting room of the Cass County Land Department located at

218 Washburn Ave East, Backus MN.

    

The field inspections will be conducted Monday, August 6, 2018 and Tuesday August 7, 2018.  A schedule is included in this notice with an estimated time of arrival at the application locations.

9:40 AM -  - Bruckbauer, Brian and Stacye, Kego Township on property described as Part of Govt Lot 6, Section 34 141 28, PID #19-034-3303 located at 1188 Glenmar Dr NE.  An application submitted to remove the existing mobile home and construct a 20’ x 26’ seasonal cabin approximately 48’ from the lake (RD).  The septic holding tank is planned to be located <50’ from the lake (RD) with a request for a closer sideyard setback. The applicable portions of the Land Use Ordinance include Section 800 which establishes variance criteria; Section 1126.1 A. which requires structures to be located 100’ and holding tanks be located 75’ from a lake classified Recreational Development (RD); and 1126.1 B which requires the septic tank to be at least 10’ from property boundaries.  The property contains 0.38 acre riparian to Girl Lake (RD). 9:55 AM -  - Cogdill Vacation Homes, Shingobee Township on property described as Part of Govt Lot 1, Section 34 141 31, PID #38-034-1405 located at 5650 50th St NW.  An application submitted to expand the existing guest quarters to 1008 sf and to exceed the 15’ height limit on guest quarters.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.5 A which establishes the criteria for guest cottages on residential lots in the Shoreland District.  The property contains 11.46 acres riparian to 10 Mile Lake (GD). The field inspection for this application will be conducted 8/6/18 at 4:35 PM.

10:10 AM -  - Ebert, John, Remer Township on property described as Rev Desct 2 of Govt Lot 3, Section 34 141 26, PID #35-034-3203 located at 4948 State Highway 6 NE. An “After the Fact” application submitted to retain an existing RV, shed and deck located within the setback of a NE lake. All development has occurred between 80’ and 120’ of the lake.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria and Section 1126.1 A which requires structures to be located 150’ from the OHWL of a NE lake. The property contains approximately 6.68 acres riparian to Big Rice Lake (NE). The field inspection for this application will be conducted 8/6/18 at 1:15 PM.

10:25 AM -  - Ertl, Shannon, Rogers Township on property described as Part of Government Lot 2 of Little Wolf Look-Out, Section 22 142 27, PID #36-022-1304 located at 8233 38th Avenue NE. An application submitted to construct an addition and connected garage/living quarters on an existing non-conforming residence. The residence is non-conforming because it is located 60’ from a RD lake and the additions/garage will not further encroach on the lake. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1115.3 which establishes the criteria for non-conforming structure expansion and Section 1126.1 A. which requires structures to be located 100 feet from a lake classified Residential Development (RD). The property contains 0.91 acre riparian to Swift Lake (RD). The field inspection for this application will be conducted 8/6/18 at 11:25 AM.

10:40 AM -  - Fahey, Brad and Michelle, Beulah Township on property described as Lot 6, Block 2 Tingdale Bros Roosevelt Trails, Section 19 139 25, PID#04-397-0212 and 04-397-0214 located at 7210 and 7220 Quentin Rd NE.  An application submitted requesting a closer lake setback (RD) for the construction of a 12’ by 24’ screened in porch. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 100’ from a lake classified Recreational Development (RD). The property contains two lots with a combined area of 0.87-acre riparian to Leavitt Lake (RD).  The field inspection for this application will be conducted 8/6/18 at 2:00 PM.

10:55 AM -  -  Hiebert, Brett, Barclay Township on property described as 560’ of N429’ of Govt Lot 4 Lyg E of the E Shore of Norway Lake, Section 31 138 29, PID#02-031-2205 located at 1953 Norway Lake Rd SW.  An application submitted requesting a closer sideyard setback to replace a 24’ x 24’ garage currently located 7’ to 8’ from the adjoining lot. The proposed garage will be 28’ x 40’ and proposed to be 3’ to 4’ from the adjoining lot. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 B. which requires structures to be located at least 10’ from the adjoining lots. The property contains 0.93-acre riparian to Norway Lake (RD).  

The field inspection for this application will be conducted 8/6/18 at 3:10 PM.

11:10 AM -  - Johnson, Douglas, Thunder Lake Township on property described as Part of Govt Lot 7, Section 15 140 26, PID #42-015-2301 located at 5880 Thunder Lake Drive NE.  An application submitted to split a 3.67 acre lot into 2 lots meeting all lot standards.  Evaluation criteria includes Section 800 of the Land Use Ordinance which establishes the variance criteria and Article 3.03 of the Subdivision and Platting Ordinance which allows for the creation of 4 lots by plat.  The property contains 3.67 acres riparian to Thunder Lake (RD).   

11:25 AM -  - Kollander, Lisa, Ponto Lake Township on property described as Lots 1 & 2 Blk 2, “Ponto Point”, Section 9 139 29, PID #32-377-0205 located at 1692 12th Ave NW. An “After the Fact” application submitted to retain an existing RV and fence located within the setback of a RD lake.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A & B which requires structures to be located 100’ from the OHWL of a RD lake and Section 1126.10 A & B which identifies the criteria for fences. The property contains approximately 1.72 acres riparian to Ponto Lake (RD). The field inspection for this application will be conducted 8/7/18 at 2:15 PM.

11:40 AM -  - Lammers, Edward, Wabedo Township on property described as Part of Govt Lot 1 and Part of Govt Lot 2, Section 20 140 28, PID #46-020-1103 located at 704 Hunter Lake Road. An application submitted to split an 8.4 acre parcel into 2 lots with 150’ and 205’ of shoreline respectively.  One lot will be 2.4 acres and the other lot 6 acres.  This action was previously approved in 2003 by variance, VP03-140-28-5 and the current application seeks the same split.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1113.1 which requires minimum lot width to be 200’ in NE – Residential. The property contains 8.4 acres riparian to Heffren Lake (NE).  The field inspection for this application will be conducted 8/7/18 at 11:20 AM.

1:00 PM -  - Landa, James and Nicole, Woodrow Township on property described as Part of Govt Lot 1 and Part of Govt Lot 1 Block 1. “Enger’s Hardwood Shores”, Section 35 140 29, PID #51-035-2213 and 51-492-0110 located at 745 Hardwood Shores Drive.  An application submitted to construct a 30’ x 30’ residence with a 510 square foot deck approximately 15’ from the top of the bluff.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 B. which requires structures to be located 30’ from the top of the bluff.  The property contains 0.26 acre riparian to Blackwater Lake (RD) and an additional 0.96 acre non-lakeshore lot.   The field inspection for this application will be conducted 8/7/18 at 1:50 PM.

1:15 PM -  - Lyons, Barry, Kego Township on property described as Lot 12, Block 1 and Easements, “Long Lake Homesites”, Section: 13-141-28, PID #19-381-0160 located at 6278 Wayward Trail NE. An application submitted to add onto an existing non- conforming residence not to increase the setback from the lake. The planned addition is a 48 square foot bathroom and a 240 square foot deck. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 75’ from the OHWL of a GD lake. The property contains approximately 0.58 acre riparian to Long Lake (GD).  The field inspection for this application will be conducted 8/7/18 at 10:20 AM

1:30 PM -  - Likens, Jack and Tony, Kego Township on property described as Part of Govt Lots 5 & 6 (South Tract), Section 27-141-28, PID #19-027-4216 located on Fahrenholtz Road. An application submitted to install a boat ramp or landing on a GD lake that already has a public launch. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria and Section and 1126.13 which establishes the criteria for watercraft access ramps. The property contains approximately 2.22 acres riparian to Long Lake (GD). The field inspection for this application will be conducted 8/7/18 at 10:45 AM.

1:45 PM -  - Pollock, Jack, Woodrow Township on property described as Part of Lot 10 “Rochleaus Point”, Section 26 139 26, PID #12-470-0101 located at 561 Shady Lane.  An application submitted to expand the existing non-conforming residence that is 76’ from the lake by enclosing a 160sf section of covered porch not increasing the footprint but to include a steeper roof pitch.  The applicable portions of the Land Use Ordinance include Section 800 which establishes variance criteria, Section 1115.3 which establishes non-conforming structure expansion criteria and Section 1126.1 A. which requires structures to be located 100 feet from a lake classified Recreation Development (RD).  The property contains 1.70 acres riparian to Lake Lawrence (RD).  The field inspection for this application will be conducted 8/6/18 at 2:20 PM.

2:00 PM -  - Seyala, Susan, Hiram Township on property described as West 150’ of Govt Lot 2, Section 10 140 31, PID #16-010-4301 located at 5698 Fernhurst Dr. NW.  An application submitted to construct a 1200 square foot guest cottage on a Shoreland Residential parcel.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.5 A which establishes the criteria for guest cottages on residential lots in the Shoreland District.  The property contains 6.0 acres riparian to 10 Mile Lake (GD).  The field inspection for this application will be conducted 8/6/18 at 4:05 PM.

2:15 PM -  - Shermock, Brian, WabedoTownship on property described as Part of Govt Lot 2, Section 21 140 28, PID #46-021-1303 located at 1085 N Hunter Lake Road. An application submitted requesting a closer lake setback (NE) for the installation of a new lift tank (137’) and drain field (102’). The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires septic tanks and drain fields to be located 150 feet from a lake classified Natural Environment (NE). The property contains 0.88 acres riparian to Little Lake (NE) and Hunter Lake (RD).  The field inspection for this application will be conducted 8/7/18 at 11:40 AM.

2:30 PM -  - Thompson, Janet, Turtle Lake Township on property described as Part of Lot 9 Lying North of Cartway, Section 35-142-30, PID #45-548-0091 located at 3126 Rocky Point Drive NW.  An “After-the-Fact” application submitted to reconstruct and expand an existing non-conforming residence located 39 feet from the lake.  A variance was granted in 2017 (VP17-142-30-2) for an addition to the non-conforming structure with septic approved. The applicable portions of the Land Use Ordinance include Section 502 which establishes existing violation criteria, Section 800 which establishes the variance criteria, Section 1115.3 which establishes the non-conforming structure expansion criteria and Section 1126.1 A. which requires structures to be setback 75 feet from a lake classified General Development (GD).  The property contains 0.5 acre riparian to Leech Lake (GD).  The field inspection for this application will be conducted 08/06/18 at 9:50 AM.

2:45 PM -  - Tilbury, William, Ponto Lake Township on property described as Part of Govt Lot 10, Tract C, Section 07 139 29, PID #32-007-4106 located at 1737 20th Avenue NW. An application submitted to construct a 22’ x 24.8’ addition (north) and a 2’ X 24.8’ deck expansion (south) to an existing non-conforming residence.  The residence is non-conforming because it is located 80’ feet from the lake and the additions/deck will not further encroach on the lake.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1115.3 which establishes the criteria for non-conforming structure expansion and Section 1126.1 A. which requires structures to be located 100 feet from a lake classified Residential Development (RD).  The property contains 5.82 acre riparian to Deep Portage (RD).    The field inspection for this application will be conducted 8/7/18 at 3:50 PM.

3:00 PM -  - Vaughn Jr., Robert, Ponto Lake Township on property described as Part of Govt Lot 1, PID #32-003-1106 located at 2237 State 84 NW. An application submitted to build a new home with an 80’ to 95’ setback and remove the existing non-conforming residence located 58’ to 63’ from the OHWL. The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1126.1 A. which requires structures to be located 100’ from the OHWL of a RD lake. The property contains approximately 0.70 acre riparian to Island Lake (RD).  The field inspection for this application will be conducted 8/7/18 at 1:30 PM.

Reclassification

3:15 PM -  - Buscho, Craig, Meadow Brook Township property described as East ½ of Govt Lot 2, Section 31 135 31, PID #26-031-2203 located at 6811 92nd St SW.  An application to reclassify two approximately 10 acre parcels from Agriculture/Forestry (AF) to Rural Residential-10 (RR-10).   The property is planned to be split into two parcels so one can be sold. The applicable portions of the Land Use Ordinance include Section 706, which establishes reclassification criteria and Section 903 which establishes land use district descriptions.  The parcel contains 20.34 acres (AF).    

3:30 PM -  - Sheldon, Scott, Pine River Township property described as Part of the East ½ of NE ¼ of the NE ¼, Section 13-138-30, PID #31-031-1102 located at the intersection of 8th St SW and 24th Ave SW.  An application to reclassify 4.57 acres from Agriculture/Forestry (AF) to Rural Residential-2.5 (RR-2.5) as the property was sold as a non-compliant lot and the owner wishes to bring it back into compliance.  RR-2.5 is consistent with other lots in this area.  The applicable portions of the Land Use Ordinance include Section 706, which establishes reclassification criteria and Section 903 which establishes land use district descriptions.  The parcel contains 4.57 acres (AF).   

3:45 PM -  - Williams, David and Sharron, Birch Lake Township on property described as Part of Govt Lot 4 (Sw ¼ of the SW ¼), Section 07 140 30, PID #05-007-3301 located at 4775 Birch Lake LN NW.  An application was submitted to split a 19.44 acre parcel into 2 lots with 75’ of shoreline and >1.5 acres each.  The applicant is requesting the property be reclassified from Water Oriented Commercial to Shoreland Residential.  The applicable portions of the Land Use Ordinance include Section 706 which establishes the reclassification procedure, Section 1113.1 which requires WOC to have a minimum lot size of 4 acres and with of 300 feet or more at the OHWL.  Two of the lots will be riparian to Birch Lake (GD) and one will be in the shoreland zone.   

3:55 PM -  - Williams, David and Sharron, Birch Lake Township on property described as Part of Govt Lot 4 (Sw ¼ of the SW ¼), Section 07 140 30, PID #05-007-3301 located at 4775 Birch Lake LN NW.  Request to modify VP18-140-30-3 as approved on 07/09/18 conditions #4 and #5 to extend the date which the cabins are to be removed from 07/01/19 to 01/01/20.

9:40AM -  - Aspen Construction, Brad Baird, WilkinsonTownship on property currently owned by Leah and Eric Crow described as the SE ¼ of the NW ¼, Section 31-144-31, PID #49-31-2400 located at 7058 122nd St. NW.  An application submitted to place >200 cubic yards of material in the shoreland zone to cover rocks and stumps.  Fill will be between 0-2’ deep to cover approximately 4.1 acres.  The applicable sections of the Land Use Ordinance include Section 705 which establishes CUP criteria and Section 1106.2 B which requires a CUP for the movement of more than 200 cu yds of earthen material behind the structure setback in the Shoreland Zone. The property contains 40.42 acres (A/F). The field inspection for this application will be conducted 8/7/18 at 9:15AM.

9:55 AM -  - Grinning Bear Roll-Off, Pine River Township on property currently owned by Stockman Trucking LLL described as S 759’ of SW NW LYG SLY and SWLY of RR ROW, Section 26 138 30, PID #31-026-2302 located at 1707 State 371 SW.  An application submitted to establish a demolition debris and construction debris transfer site.  Such land use requires a conditional use permit (CUP).  The applicable section of the Land Use Ordinance includes Section 705 which establishes CUP standards.  The property contains 23.3 acres (SR and RR 2.5). The field inspection for this application will be conducted 8/6/18 at 3:30PM.

10:10 AM -  - Tabbert, Tim, Leech Lake Township on property described as Part of the North ½ of the NE ¼ & the E ½ of the N/W ¼ (Wedgewood Golf Course), Section 3 143 31, PID #20-032-1402 located at 6542 Wedgewood Road.  An application submitted to continue use of an existing Golf Course as a Golf Course following a lot split and sale.  Outdoor Recreation activities in a Shoreland Residential area requires a conditional use permit (CUP).  The applicable sections of the Land Use Ordinance include Section 705 which establishes CUP standards and Section 1001 which establishes use requirements.  The property contains 91.79 acres (SR).   

10:25AM -  - Verizon Wireless, May Township on property owned by Brad and Beverly Ludwig described as SE ¼ of the SW ¼, Section 7 134 31, PID #24-107-0002 located near 1862 Division St W.   An application submitted to construct a 190’ lattice communications tower with a 9’ lightening rod for a total height of 199’. The applicable portions of the Land Use Ordinance include Section 705, which establishes the CUP criteria and Section 1127 which establishes the communication tower criteria and Section 1001 which establishes that communications towers require a CUP in a shoreland residential area.  The field inspection for this application will be conducted 8/7/18 at 2:50 PM.

10:40 AM -  - Wallace, Timothy, Shingobee Township on property described as Part of Govt Lot 8 (Tract 4), Section 12 142 31, PID #38-112-4308 located at 8850 Pint Point Rd NW. An application submitted, “after the fact”, to approve a family campground within 0.25 mile from Leech Lake.  The applicable portions of the Land Use Ordinance include Section 502 which establishes existing violation criteria, Section 705 which establishes the Conditional Use Permit (CUP) criteria and Section 1121 B which requires a CUP for a private campground on a residential lot. The field inspection for this application will be conducted 8/6/18 at 9:20AM.

10:55 AM -  - Dan and Steve Bosch, Boy Lake Township on property described as Part of Govt Lot 4, Section 23 142 28, PID #07-023-1403 located at 8006 County 157 NE. An application submitted to construct a new 32’ x 80’ duplex and retain an existing 575’ cabin all located beyond the setback of a GD lake.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, Section 1120 B which allows for one residential structure and one accessory dwelling unit per residential lot, Section 705 which establishes Conditional Use criteria and Section 1001 which indicates that multi-family residential in Shoreland Residential requires a CUP.  The property contains 3.84 acres riparian to Boy Lake (GD). The field inspection for this application will be conducted 8/6/18 at 10:40 AM.

Other Business

11:15AM -  - Wagner, Peggy, Kego Township on property described as Part of Govt Lot 2, Section 22-141-28, PID #19-022-1402 located at 5801 County 126 NE.  A request made to reconsider the “after the fact” variance, previously denied, to be allowed to retain a recreational vehicle trailer and two outhouses located at less than 150 feet from Maple Lake (NE) due to financial concerns with movement of structures.  All structures were placed without permit and it was determined that there was ample space on the property to meet lake setbacks.  The applicable portions of the Land Use Ordinance include Section 800 which establishes the variance criteria, and Section 1126.1 A. which requires structures and Subservice Sewage Treatment Systems (SSTS) including an outhouse to be setback 150 feet from a lake classified Natural Environment (NE).  The property contains 4.24 acres riparian to Maple Lake (NE).   

11:30 AM -  - Watson, Richard, Leech Lake Township on property described as Tract B and Tract C of Govt Lots 1 & 2, PID #20-032-1402 located north of Wedgewood Road. A request to modify the existing CUP for the mobile home community CU98-143-31-1 to remove the Golf Course.  The mobile home community currently includes 3 mobile homes and 5 RVs on Tract B and 3 mobile homes on Tract C.  The mobile homes on Tract C will be removed by demolition or sale and no additional homes are planned for either Tract.  The septic system was inspected and documented compliant on 07/25/18 for Tract B and no septic system exists on Tract C.  Tract B and C include 7.86 acres and no further splits or development is planned.
